Brokerdesk is a trade name of Simpler Software Applications Inc., a Canadian corporation ("we," "us," or "our"). Brokerdesk is a software-as-a-service (SaaS) customer relationship management platform designed for real estate professionals. This Privacy Policy explains how we collect, use, disclose, and protect personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

By creating an account or using our platform, you agree to the practices described in this policy. If you do not agree, please do not use Brokerdesk.


1. Definitions

  • "User" refers to real estate agents, teams, and brokerages who create accounts on Brokerdesk.
  • "Contact Data" refers to information about third parties (e.g., clients, leads, or other contacts) that Users input into Brokerdesk.
  • "Platform" refers to the Brokerdesk web application and any associated services.

2. Information We Collect

2.1 Account Information

When you register for Brokerdesk, we collect information necessary to create and manage your account, including your name, email address, phone number, brokerage affiliation, and billing details.

2.2 Contact and relationship data

Users may input personal information about their clients, leads, and other contacts into the Platform. This may include names, email addresses, phone numbers, property addresses, transaction details, and notes related to real estate dealings.

2.3 Property and Transaction Data

The Platform stores information related to real estate listings, properties, and deals, including property addresses, listing details, transaction amounts, closing dates, and associated parties.

2.4 Marketing and Analytics Data

When Users send communications through the Platform, we collect engagement metrics such as email open rates, click-through rates, and delivery status.

2.5 Usage and Technical Data

We automatically collect technical information when you use the Platform, including IP address, browser type, device information, pages visited, and feature usage patterns. We use cookies and similar technologies to support this collection.


3. How We Use Your Information

We use the information we collect for the following purposes:

  • Providing the Service: To operate, maintain, and improve the Brokerdesk platform, including contact and pipeline features, deal tracking, marketing tools, and reporting.
  • Account Management: To manage your account, process payments, and communicate with you about your subscription.
  • Analytics and Improvement: To understand how Users interact with the Platform and to improve functionality, performance, and user experience.
  • Communications: To send service-related notices, updates, and, where you have opted in, marketing communications about Brokerdesk.
  • Security and Compliance: To detect and prevent fraud, enforce our terms of service, and comply with legal obligations.

4. User Responsibility for Contact Data

Brokerdesk processes Contact Data on behalf of Users. Users are the controllers of the personal information they input into the Platform and are responsible for ensuring they have obtained any necessary consent from their contacts before entering that information into Brokerdesk. We process Contact Data solely as directed by the User and in accordance with this policy and our Terms of Service.


5. Disclosure of Information

We do not sell personal information. We may share information in the following circumstances:

  • Service Providers: We engage third-party service providers to help operate the Platform (e.g., cloud hosting, payment processing, email delivery, and analytics). These providers are contractually obligated to protect your information and may only use it to provide services on our behalf.
  • Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction. We will notify Users of any such change.
  • With Your Consent: We may share information for other purposes with your explicit consent.

6. Data Storage and Transfer

Brokerdesk is hosted on cloud infrastructure located in Canada and/or the United States. By using the Platform, you acknowledge that your information may be stored and processed in these jurisdictions. Where information is transferred outside of Canada, we take reasonable steps to ensure it is protected in accordance with applicable privacy laws.


7. Data Retention

We retain your account information for as long as your account is active or as needed to provide the Platform. Contact Data and other workspace data are retained until the User deletes it or terminates their account. Upon account termination, we will delete or anonymize your data within 90 days, except where retention is required by law.


8. Security

We implement reasonable technical and organizational safeguards to protect personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit and at rest, access controls, and regular security assessments. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.


9. Your Rights

Under PIPEDA and applicable provincial legislation, you have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete personal information.
  • Withdraw consent for the collection, use, or disclosure of your personal information, subject to legal or contractual restrictions.
  • Request deletion of your personal information, subject to our retention obligations.

10. Cookies and Tracking Technologies

We use cookies and similar technologies to support Platform functionality, remember preferences, and collect usage data. You can manage cookie preferences through your browser settings, though disabling certain cookies may affect your experience on the Platform.


11. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify Users by email or by posting a prominent notice on the Platform. Your continued use of Brokerdesk after such changes constitutes acceptance of the updated policy.
